Your Committee on Planning, to which was referred Bill No. 311,
L, Mand Change of Zone Ordinance

regarding Conditions J,
No . 869, Hawaiian Kona Coast Associates, Kahului , North Kona,
TMK: 7-5-19:1, 44 & 45 , reports as follows :
The purpose of Bill 311 is to amend Ordinance 869. In support of the
amendment, the Planning Commission stated, "The proposed amendments
are consistent withthe intent of the original requirements which is
to ensure the timely installation of the improvements and to avoid
adverse effects on surrounding properties . The proposed amendments
would additionally allow development to proceed while the larger
improvements are in the process of design, permitting and
construction. "
The current and proposed amendments to conditions J, L and M are as
follows :
Condition J
Current: That the petitioner, alone or in cooperation with
other property owners, shall construct and complete the
portion of the Alii Highway from Kuakini Highway to the
southern end of the subject property ---.
Amendment: Be allowed to pay a pro rata share of the cost of
constructing the highway in lieu of actually installing the
improvements . The pro rata fee will be 111,800 per acre.
Condition L
Current: That no direct access off Kuakini Highway shall be
permitted .
Amendment: To allow temporary access off Kuakini Highway
until the Alii Highway project is completed. Upon completion
of the Alii Highway project, the temporary access shall be
terminated .

Condition M
Current: That the petitioner , alone, or in conjunction with
other affected property owners and the County, shall construct
and complete drainage improvements within the Waiaha flood
plain including the replacement of the Kahului Bridge on
Alii Drive prior to the issuance of any occupancy permits on
the subject property .
Amendment: Pay a pro rata fee of 129,000 per acre in lieu of
actually installing the drainage improvements .
Condition N permits the Planning Director to administratively
grant extensions to various time conditions .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 311 and recommends that it pass first reading .
