HomeMy WebLinkAboutREP PC 178 01/13/1987 1984-1988 REPORT OF THE • COMMITTEE ON PLANNING DATE: January 13, 1987 Re: Comm. 893 PLACE: Councilroom TIME: 1: 30 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 304, regarding the rezoning request of Christopher Norrie, Kaawaloa, South Kona, TMK: 8-1-09:Portion of 2 & 14, reports as follows : Bill 304 amends Section 25-88, Article 3, Chapter 25 of the Hawaii County Code, by changing the district classification of approximately 14.45 acres of land from Agricultural 5-acre (A-5a ) to Agricultural 2-acre (A-2a) . The applicant intends to subdivide his property into seven lots. He does not plan to build any houses on the newly created lots . The Planning Department states that "The assurance of agricultural activity would be done by restrictive covenants . The desires expressed by the petitioner are clearly legitimate and should be planned for in areas such as the subject property, where the agricultural potential of the land is available. This category of zoning is suitably accomodated on this agricultural land. Based on these factors, we have determined that this agricultural policy is being implemented. " The subject property is designated as "Other Important Agricultural Lands" on the Agricultural Lands of Importance to the State of Hawaii (ALISH) map. The Land Study Bureau' s Overall Master Productivity Rating for agricultural use in this area is "C" or fair . The General Plan designates the area for Low Density; Alternate Urban and Orchard uses . The subject property is situated within the Special Management Area. Section 2 C) of Bill 304 states, in part, that (1 ) further subdivision shall be restricted for a period of 40 years or until the State Land Use designation is changed from agriculture, whichever is longer ; ( 2) guarantee that the land be substantially used for agriculture. Only 1/4 acre designated and surveyed by the first new owner may be used for residential purposes . There will be no Ghana zoning. The applicant has stated that "Although water commitment from the Department of Water Supply is for only 600 gallons a day, the Department has stated that more water may be purchased for irrigation purposes at agricultural rates , barring unforeseen circumstances . Your Committee on Planning amended Bill 304 to include revisions requested by the applicant and agreed to by the Planning Department and Corporation Counsel . However, a representative of the Planning Department stated that the Planning Director has requested that approval of the amendment be deferred to allow the Planning Department time to more closely review the amendments. Committee Chairman Domingo suggested that Bill 304, Draft 2, be forwarded to the County Council with the recommendation that it pass first reading and be recommitted to the Planning Committee.
