Your Committee on Planning, to which was referred Bill No. 302,
regarding the rezoning request of Susan Wells , Kohala Estates
Subdivision, TMK: 5-9-08: 7, reports as follows :
Bill 302 amends Section 25-95A, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 20 .15 acres of land from Agricultural 20-acre (A-20a)
to Agricultural 3-acre (A-3a) in Kahua, North Kohala.
According to the Planning Department , the petitioner plans to
subdivide the property into four lots and plans to construct her own
home on one of the lots within six months from the date of approval
of the proposed subdivision.
The subject property is situated within the State Land Use
Agricultural District. The General Plan designates the area for
Extensive Agriculture. The North Kohala Community Development Plan
designates the area for Small Scale Agricultural use .
The private water system from the Kohala Ranch development will
provide the necessary water to the proposed lots. All other
essential utilities and services are available.
The Real Property Tax Division stated that "This parcel is being
reviewed because the dedication appears to have been breached. If
this occurs , the parcel will be subject to rollback taxes . If not,
the dedication will carry on to the new lots and rollback taxes will
occur in some cases when homes are built on the property. "
