Your Committee on Planning, to which was referred Bill No. 301,
regarding the rezoning request of Brian Walsh, Kohala Estates
Subdivision, TMK: 5-9-07 :4, reports as follows :
Bill 301 amends Section 25-95A, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 28. 21 acres of land from Agricultural 20-acre (A-20a)
to Agricultural 3-acre (A-3a) .
The subject property is located in Unit I of the Kohala Estates
Subdivision. The applicant is seeking a change of zone in order to
subdivide the property into nine lots . The applicant has no plans to
construct any dwelling on the newly created lots .
In support of the application, the applicant stated, "We have cleared
the land, developed terraces and a 1/2 million gallon reservoir,
drilled an 800 ft . water well, established roads and a trunk
irrigation system for the first fourteen acres . We also have two
other water tanks with a holding capacity of an additional
30,000 gallons , a 600 square feet house and a storage building. "
The applicant further stated that "At this stage we are forced to
sell an undivided interest in our land to be able to move forward
into Phase II. " According to the applicant, Phase II involves the
planting of fruit and windbreak trees .
The subject property is situated within the State Land Use
Agricultural District . The General Plan designates the area for
Extensive Agriculture. The North Kohala Community Development Plan
designates the area for Small Scale Agricultural use .
The Real Property Tax Division stated that "Due to the poor results
of agricultural projects in this area, there may be problems in
dedicating the subdivided parcels to agricultural use. "
Water will be provided by Kohala Ranch ' s private water system. The
Planning Department stated, "The availability of water being provided
would be sufficient to meet the needs and demands of the proposed
subdivision. "
