Your Committee on Planning, to which was referred Bill No. 299,
regarding the rezoning request of Max Sherrod, et al . , Kohala Estates
Subdivision, Kahua, North Kohala, Hawaii , Tax Map Key 5-9-08:6,
reports as follows :
Bill No. 205 amends Section 25-95A, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 20.32 acres of land from Agricultural 20-acre (A-20a)
to Agricultural 3-acre (A-3a) .
According to the Planning Department, this change of zone request is
one of six applications currently being processed by the department
involving zoning change to Agricultural (3a) in Kohala Estates .
The applicant 's are planning to subdivide the property into four
lots, ranging in size from three to five acres.
The private water system from the Kohala Ranch development will
supply water to the proposed subdivision. In reference to this
application, the Department of Water Supply stated that "Pursuant to
the Subdivision Code, the subdivision shall be provided with water
service meeting Department of Water Supply minimum water
requirements . "
According to the County Tax Office, the property has been dedicated
for agricultural purposes . However, the Real Property Tax Division
stated that "This parcel is being reviewed because the dedication
appears to have been breached. If this occurs , the parcel will be
subject to rollback taxes. If not, the dedication will carry on to
the new lots and rollback taxes will occur in some cases when homes
are built on the property. "
The property is situated within the State Land Use Agricultural
District . The General Plan designates the area for
Extensive Agriculture. The North Kohala Community Development Plan
designates the area for small scale agricultural use.
