Your Committee on Planning, to which was referred Bill No. 296,
regarding the rezoning request of AHIMSA Associates , Kohala Estates
Subdivision, Kahua, North Kohala, Hawaii , TMK: 5-9-07:5, reports as
follows:
Bill No. 296 amends Section 25-95A, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 27 .22 acres of land from Agricultural 20-acre (A-20a)
to Agricultural 3-acre (A-3a) .
The subject property is located within the Kohala Estates Subdivision.
The Planning Department has stated that "This change of zone request
is one of six applications which are presently being processed by the
Planning Department asking for the same type of Agricultural 3-acre
zoning in generally the same area. "
The petitioners plan to subdivide the subject property into seven
lots each approximately three acres in size. They plan to construct
single family dwellings on three of the lots , within six months after
approval of the subdivision.
According to the County Tax Office, the property has been dedicated
for agricultural purposes . The Real Property Tax Division stated
that "This parcel is being reviewed because the dedication appears to
have been breached. If this occurs , the parcel will be subject to
rollback taxes . If not, the dedication will carry on to the new lots
and rollback taxes will occur in some cases when homes are built on
the property. "
The private water system from the Kohala Ranch development will
provide the necessary water to the proposed lots . All other
essential utilities and services are readily available.
The subject property is located within the State Land Use
Agricultural District. The County General Plan designates the area
for Extensive Agriculture. The North Kohala Community Development
Plan designates the property for Small Scale Agricultural use.

Your Committee on Planning is in accord with the intent and purpose
of Bill 296 and recommends that it pass first reading.
