Your Committee on Planning, to which was referred Bill No . 261 ,
regarding the rezoning request of Keith Tom, Kalaoa , North Kona ,
TMK: 7-3-04: 4 , reports as follows:
Bill 261 amends Section 25-87 , Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 5 .9 acres of land from Agricultural 20-acre (A-20a ) to
Agricultural 1-acre (A-la ) .
The property fronts the mauka side of the Old Government Mauka Road,
adjacent to the old Kalaoa School .
The applicant intends to subdivide the property into five 1-acre lots
for distribution among family members .
The applicant had submitted a similar rezoning request in June of
1984. in August 1984 , the former Planning Director denied the
request because of: (1 ) the unavailability of an adequate supply of
water to the proposed subdivision and ( 2 ) the substandard condition
of the roadway serving as access to the property.
The Planning Director 's decision was appealed to the
Planning Commission on August 31 , 1984 by the applicant . At its
October 24 , 1984 meeting, the commission voted to continue the
hearing to allow the applicant and Planning Director an opportunity
to seek other alternatives .

During this period, the change of zone procedure was amended whereby
the Planning Director no longer has the authority to deny a request .
Therefore, according to the Planning Department, the applicant has
requested that his application be processed under the current
procedure.

The Planning Commission is recommending that the request be approved
because:
1 . The Planning Department has reconsidered its water
policy relative to rezoning and subdivision requests .
Proposals aimed at dividing land among relatives may be
considered even if adequate water is not available . In
these cases , however , restrictive deed covenants will be
imposed , allowing conveyances to a third party only if
there is either : (a ) a valid water commitment, (b ) water
service to the site , or (c ) a water catchment system
that satisfies County standards which may be adopted for
such a system.
2. In reference to the concern expressed in August 1984
regarding the substandard condition of the access road ,
a condition of approval (Condition D) is being proposed
in Bill 261 to correct this problem .
The General Plan designates the area as Orchards and Alternate Urban
Expansion. The Kona Regional Plan designates the area for A-la to
A-3a zoning.
With the exception of water , all other essential utilities and
services are available to the property .
Your Committee on Planning is in accord with the intent and purpose
of Bill 261 and recommends that it pass first reading .
