Your Committee on Planning, to which was referred Bill No . 253 ,
relating to smoking in public places , reports as follows :
Bill 253 amends Chapter 14 , Article 4 , Hawaii County Code 1983 , as
amended, in its entirety .
The purpose of Bill 253 is to protect the public health , comfort,
safety, property and general welfare of the inhabitants of the County
of Hawaii by regulating smoking in public places .
Councilwoman Merle Lai , co-author of the bill recommended several
amendments to the bill . The amendments are as follows:
1 . Section 14-20 (e ) is deleted in its entirety .
2 . Section 14-21 (b ) is amended as follows: Private and
semi-private rooms , wards , waiting rooms , lobbies and
public hallways of [public and] private health care
facilities , including, but not limited to , hospitals ,
clinics, and physicians ' and dentists ' offices .
3. Section 14-21 (b ) (1 ) is deleted in its entirety .
4 . Section 14-21 (b ) (2) is changed to Section 14-21 (b ) (1 )
and amended to read: Nothing in this section shall
prevent a facility from establishing waiting areas where
smoking is permitted where said smoking areas comprise
no more than 50 percent of the waiting area space in
said facility if said smoking areas are physically
separated by walls so that smoke does not permeate into
nonsmoking areas .
5 . Section 14-21 (e ) is amended as follows: The following
facilities or areas in [ City] -County-owned or controlled
buildings :
Your Committee has amended the bill accordingly.

Councilwoman Lai informed the committee that she intends to hold
public hearings on the bill and requested
Committee Chairman Takashi Domingo to appoint a sub-committee to
conduct these hearings .
Your Committee on Planning is in accord with the intent and purpose
of Bill 253, Draft 2, and recommends that it pass first reading .
Note: Brackets and underscoring are being used in the committee
report only and will not appear in Draft 2 of Bill 253 .
