Your Committee on Planning, to which was referred Bill No. 250 ,
regarding Conditions C and D of Change of Zone Ordinance No . 601 ,
involving Aina-Lani Partnership, TMK: 7-5-04 :35 (formerly portion of
parcel 2) , reports as follows:
The applicant is requesting that Condition C of Ordinance 601 be
deleted in its entirety. The Planning Commission is recommending
that Condition C be amended rather than deleted. In support of their
decision, the Planning Commission stated: "The intent of imposing
performance time conditions is to provide assurance that construction
of developments commence within specified periods of time .
Therefore, to grant the request to delete Condition C would be
contrary to the stated policy regarding the imposition of time
performance conditions . "
The amendment to Condition C will enable the applicant to revise his
original development plan, while still retain the time performance
condition.
Bill 250 also amends Condition E, to authorize the Planning Director
to grant extensions to the time performance condition and to initiate
rezoning of the property to its original or more appropriate
designation if any of the conditions in the bill are not
substantially complied with in a timely fashion.
According to the Planning Department , the Kailua Village Special
District and Urban Design Review Commission, at its May 12, 1986
meeting, recommended that the request to delete Condition C be
approved.

Your Committee on Planning is in accord with the intent and purpose
of Bill 250 and recommends that it pass first reading.
