Your Committee on Planning, to which was referred Bill No. 242
regarding Condition F of Change of Zone Ordinance No. 416 ,
Kamuela Development Corporation, TMK: 6-2-01:10 and 68, reports as
follows :
Bill 242 amends Condition F (Park Requirement ) of Change of Zone
Ordinance No. 416 to correct a typographical oversight .
Ordinance 416 amended Ordinance 148, which rezoned 57 acres of land
from Agricultural 40-acre (A-40a ) to Single Family Residential
15, 000 square foot (RS-15 ) in Kamuela View Estates Subdivision,
South Kohala.
At the time of rezoning, Ordinance 148 imposed Condition F, which
required, in essence, that a minimum area of three acres be set aside
within the subject area for park and recreational use. Ordinance 148
was approved in October 1975 .
In 1978 the developer requested that Condition F be amended to allow
the developer to contribute $25, 000 in lieu of dedicating land for
park use.
In December 1978, the Planning Commission recommended to the
County Council that the original requirements of Condition F of
Ordinance 148 be deleted and replaced by the developer 's
recommendation.
The Council concurred and Ordinance 416 was adopted specifically to
replace the original Condition F with a new condition which assessed
the developer $25, 000 for park and recreational use.
It was recently brought to the attention of the Planning Department
that when Ordinance 416 was adopted, brackets to denote the deletion
of the original Condition F were inadvertently omitted .
The purpose of Bill 242 is to correct this oversight.
It should be noted that Council Chairman Stephen Yamashiro reported
to the County Council, at its meeting of September 3, 1986, that the
County of Hawaii has received a check for $25 ,000 from
Kamuela Development Corporation, as per requirement of Condition F.

Your Committee on Planning is in accord with the intent and purpose
of Bill 242 and recommends that it pass first reading.
