Your Committee on Planning, to which was referred Bill No. 221,
regarding the rezoning request of Waiono Meadows Ranch, Ltd. ,
North Kona, Hawaii , TMK: 7-6-01:1, 7-6-02:1 and 14 and 7-5-15 :2 and
12, reports as follows :
Bill No. 221 amends Section 25-86 (North and South Kona Districts
Zone Map ) and Section 25-87 (North Kona Zone Map ) , Article 3 ,
Chapter 25 of the Hawaii County Code, by changing the district
classification of approximately 1 ,813 acres of land from
Agricultural 1-, 5- and 20-acre minimum lot sizes (A-la, A-5a and
A-20a ) to Agricultural 3-, 50-, 100- and 1, 000-acre minimum lot sizes
(A-3a, A-5 0a, A-100a and A-1, 000a ).
The property involved is located above Holualoa Village, mauka of
Mamalahoa Highway.
The proposed development will include 106 3-acre sized
residential-agricultural lots in the lower portion of the property
along with a 60-acre equestrian center and a 167-acre ranching and
trail-riding area. The remaining 1, 161 acres will be used for
ranching.
According to the Planning Department, "there is no complete drainage
system in the area to handle flood waters. Rapid natural drainage
occurs due to the sloping nature of the area, however, well defined
streams are not present due to the young geological age of the soils . "
The property is located in the upper portions of the Waiaha,
Horseshoe Bend and Holualoa School streams , all of which pass through
the subject property. All three of the streams have caused property
damage in previous storms since the streambeds are not sufficiently
deep.
Three injection wells, each measuring approximately 80 feet in
diameter and 30 feet deep will be constructed at the 2,900-foot ,
2,750-foot and 2,200-foot elevations, as a means of controlling
flooding.

Your Committee held a public hearing on the proposed development, in
Holualoa, on August 11 , 1986. A number of individuals who reside
below the proposed subdivision testified in opposition to the
development. Their opposition was based largely on the fear that the
development will aggravate flooding conditions. Several written
testimonies recommending disapproval were also received at the
hearing.
Your Committee agreed with the developer that Bill 221 should be
amended as follows:
1 . Section 3(H ): The word "eliminate" has been changed to
"alleviate" because, according to the developer , it is
impossible to eliminate flooding.
2. Section 3(J ): The following sentences were added to this
section: "Monies from said fund shall be used to provide
an annual inspection of the on-site drainage systems
within the road rights-of-way and all other common areas
such as the proposed injection wells by an independent ,
certified civil engineer and, as may be needed,
corrective measures shall be taken. The first inspection
shall occur one year after final subdivision approval of
the first zoning increment and every year thereafter . A
report of the inspection and corrective measures taken
shall be submitted to the County Department of
Public Works and Planning Department within sixty days
after the start of the annual inspection. "
Councilman Kokubun suggested that Bill 221 be referred to the Council
for first reading and be recommitted to the Planning Committee for
further discussion because many issues require further clarification
and many questions remain unanswered. Councilman Kokubun referred
specifically to questions regarding the enforceability of deed
covenants , the adequacy of the maintenance fund and the number of
injection wells that would be required to adequately minimize
flooding.

Your Committee on Planning is in accord with the intent and purpose
of Bill No. 221 and recommends that it pass first reading, as
amended, and be recommitted to the Committee on Planning for further
discussion.
