Your Committee on Planning, to which was referred
Communication No. 699, regarding the rezoning request of
Ahualoa Development, Inc. , Kapaanui and Kou, North Kohala, Hawaii ,
TMK: 5-7-02:11, reports as follows :
Communication 699 is a cover letter from Sandra Pechter Schutte,
attorney for the applicant, transmitting a revised version of
Bill No. 149. Bill 149 amends Section 25-91, Article 3, Chapter 25
of the Hawaii County Code, by changing the district classification of
approximately 214 acres of land from Unplanned (U ) to
Agricultural (A-la ) .
The revised version of Bill 149 includes the addition of several
development conditions that were agreed upon between representatives
of the applicant and the Kohala community. The additional conditions
are individually listed in Mrs . Schutte 's cover letter .
The revised bill also retains the original conditions of the bill
which was approved by the Planning Commission .
Councilman Kokubun stated that representatives of the Kohala
community should be commended for having spent the time and effort to
negotiate with the developer ; however, his concerns regarding the
Kapaanui development remains unchanged. Councilman Kokubun stated
that the proper land use designation for the proposed development
should be Rural and the County zoning designation should be
Residential and Agricultural. He stated that the developer should be
required to seek the proper designations .

Your Committee on Planning disagrees with the intent and purpose of
the revised version of Bill 149 ; therefore, recommends that it be
denied.
