Your Committee on Planning, to which was referred Bill No. 217,
regarding a request for time extension to meet the requirement of
Condition D of Change of Zone Ordinance No. 84-9, reports as follows:
The purpose of Bill No. 217 is to amend Section 25-87, Article 3,
Chapter 25 of the Hawaii County Code, relating to the modification ot
condition to Ordinance No. 84-9 which reclassified certain land from
Unplanned (U) to Open (0) and Limited Industrial (ML -la) at Keahuolu,
North Kona, Hawaii, TMK: 7-4-08:Portion
The property is located on the northeast side of the existing Konv
Industrial Subdivision, between Queen Kaahumanu Highway and the
Old Kona Airport Road.
The change of zone application was approved in February, 1984. The
intent was to develop a 76 -lot industrial park with lots ranging in
size from one to two acres. Kuakini Corporation was to be the
ieveloper under a development agreement with the landowner,
Liliuokalani Trust.
Condition D of the ordinance stated that "Subdivision plans for the
first increment shall be submitted within one year from the effective
date of the zone change." In January, 1985, Liliuokalani Trust
requested for and received a one-year extension to Condition D.
Kuakini Corporation recently filed for Chapter 11 bankruptcy.
Liliuokalani Trust is requesting another one-year extension to enable
them to get the project in motion again.
Condition D is amended to read: "subdivision plans for the first
increment shall be submitted within one year from the effective date
of this amendment."
