Cafeteria TIME: 11:40 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 215 , reports as follows: The purpose of Bill No. 215 is to amend Section 25-87, Article 3, Chapter 25 of the Hawaii County Code, relating to the modification of conditions to Ordinance No. 83-38 which reclassified certain lands from Open (0) to Limited Industrial (ML-la ) at Kaloko, North Kona, Hawaii , covered by TMK: 7-3-51:1 (Portion) , 2-59 (formerly 7-3-09:Portion of 1) . Specifically, Conditions F and J of the ordinance are being amended. The property involved is the Kaloko Light Industrial Subdivision situated along the mauka side of the Queen Kaahumanu Highway. Ordinance No. 83-38, adopted on October 26, 1983, rezoned about 126 acres of land from an Open (0) to a Limited Industrial (ML-la ) zone. Condition F requires TSA International, Inc. to construct an 80-foot wide road between Queen Kaahumanu Highway and the Hawaii Belt Road. The condition also states "the construction of this roadway shall commence no later than the start of construction of the infrastructural improvements of the first increment and shall be completed prior to the issuance of final subdivision approval of the second increment. " As reflected in Condition F, the construction and completion of the mauka-makai road depends on TSA International 's ability to proceed with the second increment. As such, there is no definite timetable for the construction of this road. The completion of the mauka-makai connector road is critical to developments in the mauka area in the vicinity of the Hawaii Belt Road. Palani Road, which is the primary route to the central business and employment areas in Kona, is already heavily overtaxed . The Department of Public Works has stated that further rezoning in the mauka areas prior to completion of an alternative route to Kailua will directly impact Palani Road, PC REPORT No , 135 ADOPTED : JUL 16 1986 r S 111 PC- 135 Page 2 July 8, 1986 In light of these concerns, the Planning Commission is recommending that Condition F be deleted in its entirety and be replaced with the following: " (F) within four months of the effective date of this amendment, the petitioner shall initiate an Improvement District for the construction of the mauka-makai road within its properties . Should the County Council not approve the Improvement District, the petitioner shall begin construction of the roadway by June 30, 1988, with completion two years hence; " . Condition J of the ordinance states, in part, "prior to receipt of final subdivision approval , a Development Design Manual shall be prepared and submitted to the Planning Department for approval. The purpose of the manual is to provide comprehensive design principles and guidelines for the development of the industrial lots in order to achieve a high standard of quality for the development. " Since the approved Development Design Manual did not reflect any enforcement procedures , the Planning Director is initiating a change to Condition J which would require the Planning Director to enforce the provisions of the Development Design Manual . Condition J is amended by adding the following sentences : "No development shall occur on the lots unless it conforms to the standards and guidelines articulated in the Development Design Manual . The Planning Director shall be responsible for the enforcement of the Development Design Manual; " .
