Cafeteria TIME: 11: 40 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii. 96720 Your Committee on Planning, to which was referred Bill No. 207, regarding the rezoning request of W. H. Shipman, Ltd. , Keaau, Hawaii , TMK: 1-6-03:7 (por . ) & 78, reports as follows: Bill No. 207 amends Section 25-103, Article 3, Chapter 25 of the Hawaii County Code, by changing the district classification of approximately 488 acres of land from Agricultural 20-acre (A-20a) to a General Industrial 20,000 square feet (MG-20) . The applicant plans to develop an industrial park of approximately 400 lots ranging in size from 20,000 square feet to 10 acres. The park will be developed in two increments of 312 and 176 acres . The first increment will be developed in several phases and is expected to take five years at a cost of approximately $12.2 million. The subject property is located about 6 miles from Hilo and is adjacent to State Highway 11 . The General Plan designates the property for industrial uses . Prior to the 1979 General Plan Revision Program, the property was designated for Orchard uses . During the update, the County determined that there was a definite demand for additional industrial lands . The State Land Use Commission reclassified the property from an Agricultural to an Urban District effective February 19, 1985 . All essential utilities are immediately available to the property. PC REPORT No . 132 ADOPTED : JUL 16 1986 111 111 PC- 132 Page 2 July 8, 1986 Your Committee heard from Mr . Roy Blackshear , President of W. H. Shipman, Ltd. Mr . Blackshear requested clarification of Condition C of the bill which makes reference to the condition that the zoning of the second increment shall be effective "after construction has been partially completed to the extent that roofs have been constructed on a minimum of twenty-five percent of the lots proposed for the first zoning increment. " Planning Director Albert Lyman stated that since the lots will be of varied sizes, the condition could refer to either the number of lots or amount of land area . The fourth sentence of Condition C is amended, as follows, to reflect the Planning Director 's recommendation: "Development" means that building permits have been issued for industrial structures and construction has been partially completed to the extent that roofs have been constructed on a minimum of twenty-five percent of either [the] lots or developable land area proposed for the first zoning increment ; " The second sentence of Condition M is also amended by replacing the words Housing Agency with Office of Housing and Community Development. Your Committee on Planning is in accord with the intent and purpose of Bill 207, as amended, and recommends that it pass first reading.
