Cafeteria TIME: 11: 40 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 205, regarding the rezoning request of Henry Kveen, et al , Kaloko Mauka Subdivision, Increment I, Kaloko, North Kona, Hawaii , TMK: 7-3-24:4, reports as follows : Bill No. 205 amends Section 25-86, Article 3, Chapter 25 of the Hawaii County Code, by changing the district classification of approximately 23 acres of land from Agricultural 20-acre (A-20a ) to Agricultural 3-acre (A-3a ) . The Planning Commission is recommending that the application be approved, over the Planning Director 's previous recommendation that it be denied. During the meeting of your Committee on Planning, Planning Director Albert Lyman stated that he has reassessed his position and now supports the application, based on additional information he has received from the Department of Public Works . The Director stated that the Department of Public Works believes that if rezoning is limited to lots below the 2, 100 foot elevation, the additional number of lots which will be created should not severely overburden the existing infrastructure . The Kona Soil and Water Conservation District is recommending denial of the application because of flooding problems which may be created with the development of new structures and paved roads . The Department of Public Works had earlier recommended denial because additional lots will further overburden existing infrastructure which was designed and built for a specific and limited number of lots . In recommending approval, the Planning Commission stated that "with regards to drainage, mitigating conditions can be imposed as part of the rezoning process which would require the petitioner to comply with at the time of subdivision review. " The Department of Water Supply stated that "The applicant is a participant in the Kona Source Agreement I for seven (7 ) units . " Under this agreement, water will be provided to the applicant as soon as water sources are developed. PC REPORT N0 , 130 ADOPTED : JUL 16 1986 a <f • 411 PC- 130 Page 2 July 8, 1986 In 1982, the applicant submitted an application to rezone the property to an A-3a designation. The application was denied by the Planning Director. The applicant appealed to the Planning Commission and the Commission upheld the Director 's decision . The applicant then appealed to the Board of Appeals. The Appeals Board upheld the Commission 's decision. However , according to the applicant 's attorney, "The Board did, however , go on to state that if the policy of the County was changed and if other parcels were allowed to rezone and subdivide, then the applicants should be given the same consideration. " It should be noted that the application of Donald Severson, et al, to rezone a parcel from A-20a to A-3a was approved by the Council about a year ago. This parcel also fronts Hao Street and is located directly across the subject property. (Exhibit A of Bill No. 205 ) Councilwoman Lorraine Jitchaku-Inouye recommended that the Committee on Public Works look into this matter further to evaluate what, if any, negative impact further rezoning of lots and the resulting increase in traffic will have on the intersection of Kaloko Drive and the Hawaii Belt Road. Kaloko Drive is the primary road that leads into the subdivision. Councilwoman Merle Lai , Chairperson of the Committee on Public Works, agreed to Councilwoman Jitchaku-Inouye 's recommendation .
