Your Committee on Planning, to which was referred Bill No. 203,
regarding a request for time extension to meet the requirements of
Condition C of Change of Zone Ordinance No. 706, reports as follows:
The purpose of Bill 203 is to amend Section 25-107 , Article 3,
Chapter 25 of the Hawaii County Code, as amended, relating to the
modification of a condition to the district classification from
Single Family Residential (RS-15 ) to Village Commercial (CV-10) in
Puna, Hawaii , TMK: 1-5-13:35 .
The change of zone application was approved in August, 1981. Along
with the change of zone application, the applicant intended to
consolidate several parcels with the property being rezoned.
Consolidation was granted on December 11, 1981 .
Condition (C) stated "that plans shall be submitted and final plan
approval secured within one (1 ) year from the date of receipt of the
consolidation plan". Based on the date consolidation plan was
granted, the applicant should have received final plan approval by
December 11, 1982.
The applicant has requested and received several administrative time
extensions to comply with Condition (C) . The latest request was made
on January 31, 1986 .
The applicant 's original plan was to build a medical office complex
on the property and had been negotiating with the Hilo Medical Group
regarding the possibility of establishing certain medical facilities
on the property.

The applicant is presently discussing the possibility of developing
an elderly housing complex on the property with the County 's Office
of Housing and Community Development. The additional time granted by
this extension request will allow the applicant time to finalize and
submit such plans for review.
The applicant still plans to build a medical office complex.
However, he plans to develop an adjacent property for this purpose.
The time extension will also enable the applicant to coordinate the
development of all of his commercial zoned lands .
Condition (J) of the bill is also amended by deleting the sentence
"Should any of the foregoing conditions not be met , rezoning of the
area to its original or more appropriate designation may be
initiated", and by adding the following:
"The Planning Director may administratively grant
extensions to the foregoing time conditions . Further ,
should any of the foregoing conditions not be met or
substantially complied with in a timely fashion, the
Director may initiate rezoning of the area to its
original or more appropriate designation. "
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 203 and recommends that it pass first reading.
