HomeMy WebLinkAboutREP PC 122 06/09/1986 1984-1988 REPORT OF THE COMMITTEE ON PLANNING DATE: June 9 , 1986 Re: Comm. 608 PLACE: Keaau Community/School Library TIME: 10: 00 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 200 , regarding a request for time extension to meet the requirements of Conditions D and E of Change of Zone Ordinance No. 870 , reports as follows: The purpose of Bill 200 is to amend Section 25-87 (North Kona Zone Map ) and Section 25-89 (Kailua Urban Zone Map) , Article 3, Chapter 25 of the Hawaii County Code, relating to the modification of conditions to the district classification from Unplanned (U) to Multiple Family Residential (RM-4) and (RM-7) and from Double Family Residential (RD-3.75 ) to Multiple Family Residential (RM-4) , in North Kona, Hawaii , Tax Map Key 7-5-18 : 16 and 7-5-19:portion of 5 . Condition D, as amended, requires the applicant to submit subdivision plans within one year from the date of receipt of an SMA Use Permit . Condition E requires the applicant to submit plans for Plan Approval within one year from the date of receipt of an SMA Permit. Condition B is also amended to require the developer to submit an overall site development plan for the approval of the Chief Engineer and the Planning Director within one year from the effective date of this amendment. In reference to Conditions D and E, two administrative time extensions have already been granted . The second extension required compliance by April 18, 1986 . On January 24 , 1986 , the applicant requested another time extension. In support of the request, the applicant stated, in part, that "Our property lies within the Waiaha flood plain and drainage improvements are needed in order for us to proceed with development . During the past year , our consultants, with the Department of Public Works and others , have been trying to work out a drainage plan for the entire system and not just a segment . The problems involved are significant and the solutions have been slow due to the scope of studies needed to come to an agreement on how the system will work . '.d 111 Ili PC-122 Page 2 June 9 , 1986 The bill is also amended by adding a new condition referred to as Condition (M) which reads: "A SMA Use Permit application for the proposed development, if applicable, shall be submitted within one year from the date of approval of the overall site development plan required under condition B, above. The Planning Director may administratively grant extensions to the foregoing time conditions . Further , should any of the conditions not be met or complied with in a timely fashion, the Director may initiate rezoning of the property to its original or more appropriate designation. " At the request of Councilman Kokubun, Planning Director Albert Lyman stated that the Planning Committee will be informed whenever extensions to conditions are granted. Mr . Lyman stated that copies of letters granting such extensions will be sent to the Planning Committee . Mr . Lyman added that Corporation Counsel is reviewing a resolution, prepared by the Planning Department , which would authorize the Planning Director to administratively grant extensions to certain conditions . The resolution will be transmitted to the County Council via the Planning Commission.
