Your Committee on Planning, to which was referred
Bill No . 189 , regarding Condition E of Change of Zone
Ordinance No . 85-86 which rezoned 34. 89 acres of land from an
1 Unplanned (U) to an Agricultural 3-acre (A-3a ) zoned district ,
reports as follows:
The purpose of this bill is to amend Section 25-87 (North Kona Zone
Map) Article 3, Chapter 25 of the Hawaii County Code , relating to the
modification of a condition to the district classification of a
34 .89 acre parcel in North Kona , identified as
Tax Map - -Key7305: arcel 9 .

Condition E of Ordinance No . 85-86 states that all access shall be
from interior or county roads and that no access shall be given to
the Hawaii Belt Road. Bill No . 189 deletes Condition E in its
entirety and replaces it with the following:
"E. All access shall be from the interior roads , with the
exception of two of the proposed lots fronting the Hawaii
Belt Road. A 10-foot wide, 'no vehicle access , ' planting
screen easement along the frontage of the two proposed
lots which border the Hawaii Belt Road, exclusive of the
access points , shall be provided. Further , any access
connection to the Hawaii Belt Road shall meet with the
standards of the State Department of Transportation ,
Highways Division . ”
The Department of Transportation has informed the Planning Department
that it has no objection to modifying Condition E as proposed .
While conferring with the State Highways Division , the applicant
discovered that an access to the Hawaii Belt Road has been in
existence since the mid-1950' s when the Belt Road was constructed.
Therefore , two lots are being allowed access to the Belt Road , via
the existing access .

of Bill No . 189 and recommends that it pass first reading .
