Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 158 , reports as follows: Bill 158 amends Section 25-91 and Section 25-95 , Article 3 , Chapter 25 of the Hawaii County Code , by changing the district classification of approximately 456 acres of land in South Kohala, Hawaii , covered by tax map key 6-2-01: 62, 63 , 78 , 79 and portion of parcel 51 and tax map key 6-2-02:portion of parcel 12. The bill passed first reading of the County Council on May 7 , 1986 and was recommitted to the Planning Committee as per recommendation of the Committee . As stated in your Committee Report of April 29 , 1986 , Committee Chairman Takashi Domingo queried Planning Director Albert Lyman regarding the petitioner 's plans for providing housing for employees and also temporary housing for construction workers . Your Committee heard testimony from Planning Director Albert Lyman, who offered to the Committee , for their consideration, proposed amendments to Condition (C) of Bill 158 . Condition (C) applies to employee housing requirements . (Mr . Lyman 's letter containing the proposed amendments is identified as Communication No . 485 .6) . Mr . Lyman also suggested that the inclusion of a new condition which would require the petitioner , to the extent possible and feasible, to hire local contractors and local residents . After discussing Mr . Lyman 's proposals , your Committee voted to amend Condition (C) and voted against including the new condition. The amendments are reflected in Draft 2 of Bill No . 158 and reads as follows: (C) the petitioner , successors or assigns shall be responsible for satisfying a basic housing requirement by providing or causing the provision of affordable housing units to meet the direct and indirect construction and resort hotel employee housing demands generated by the resort development [or by undertaking other related mitigation measures , such as employee training] . Prior to Final Plan Approval, an PC REPORT No . 114 ADOPTED : MAY 21 1986 r" • • PC-114 Page 2 May 13 , 1986 affordable housing need study shall be prepared and submitted to the Planning Director and the Hawaii County Housing Agency estimating the resort housing demand to be generated by the proposed hotel development . The Planning Director and the Hawaii County Housing Agency may adjust the resort hotel employee housing requirement based on the findings contained in the report and other applicable information . Prior to commencing construction of the hotel , the manner in which the required affordable employee housing units [ or other related mitigation measures] are to be provided shall meet with the approval of the Planning Director and the concurrence of the Hawaii County Housing Agency. Furthermore , the requirements of this condition, including the provision of the required employee housing units [ or other related mitigation measures] , shall be complied with prior to the hotel commencing operation . [The satisfaction of the housing requirement imposed by the State Land Use Commission shall count towards the fulfillment of the housing requirement imposed by this condition; ] Your Committee on Planning is in accord with the intent and purpose of Draft 2 of Bill No . 158 and recommends that it pass second reading .
