Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 148 , reports as follows: Bill No . 148 amends Chapter 2, Article 15 , Section 2-91 . 3, Subsection (b) (5 ) of the Hawaii County Code , relating to Lobbyist Registration. The bill passed first reading of the Council on April 9 , 1986 and was recommitted to the Planning Committee as per recommendation of the Committee . As stated in your Committee Report dated March 24 , 1986 , Councilmembers Russell Kokubun, Robert Herkes and James Dahlberg questioned the necessity for the amendment. Committee Chairman Takashi Domingo was instructed to request an opinion from Corporation Counsel and Prosecuting Attorney as to the legality of the proposed bill . Committee has received and reviewed the Your opinions from Corporation Counsel and Prosecuting Attorney . Memorandum from Prosecuting Attorney Jon Ono, dated April 7 , 1986 , states that "We have reviewed the proposed bill and minutes and see no problem with it since it does not involve any criminal matter . " Memorandum from Corporation Counsel Ronald Ibarra , dated April 9 , 1986 , states that "The present ordinance on lobbyist registration already exempts certain groups , one of which is attorneys . " Also, "If the exemption were to cover only those attorneys who , in the process of rendering professional legal services , must communicate with any official in the legislative and executive branches , then the applicable exemption provision should be drawn more narrowly so as not to exempt those who are hired specifically to lobby. " PC REPORT No . 111 ADOPTED : MAY 7 198 111 pC- 111 Page 2 April 29 , 1986 Corporation Counsel suggested amendments to Bill No . 148 . Your Committee concurs with the recommendations and has incorporated the following amendments: " (E) Any attorney [who advises his clients on the construction or effect of proposed legislative or administrative action] authorized to practice law in the state of Hawaii , who , while practicing law, represents clients who are affected by any proposed legislative or administrative action by the council or any administrative agency. The practice of law comprehends all the activities of a lawyer in advising and assisting others in any legal matter in and out of court; " Your Committee on Planning is now in full accord with the intent and purpose of Bill 148 , Draft 2, as amended, and recommends that it pass second reading .
