Your Committee on Planning, to which was referred Bill No . 161,
regarding the rezoning request of Stuart Oda, Ponahawai , South Hilo ,
Hawaii , TMK: 2-3-12 :18 , reports as follows:
The purpose of this bill is to change the district classification of
a 3 ,137 square foot parcel of land from a Multiple Residential -
1 ,000 square foot (RM-1 ) to a General Commercial - 7 ,500 square foot
(CG-7 .5 ) zoned district . The property is located on the corner of
the Ponahawai Street-Ululani Street intersection .
The applicant plans to convert an existing 2-story single family
dwelling on the property into his law office by making slight
modifications to its interior .
Properties in the neighborhood are zoned General Commercial ,
Office Commercial and Multiple Residential .
The Department of Public Works has stated that "The sidewalk , curb
and gutter fronting the property is in poor condition . In accordance
with Chapter 22 (Hawaii County Code ) the property owner fronting
these facilities is responsible for its repair and maintenance .
Recommend the replacement of these facilities as part of the site
improvements . "
The General Plan designates the property for High Density Urban use .
Such a designation may allow general and office commercial uses . The
Commercial element of the General Plan also states that commercial
facilities shall be developed in areas adequately served with
essential services such as water , other utilities and transportation
systems . The subject property is provided with all of these services
and utilities .
