Your Committee on Planning, to which was referred Bill No . 148,
reports as follows:
Bill No . 148 amends Chapter 2, Article 15 , Section 2-91 . 3,
Subsection (b ) (5 ) of the Hawaii County Code , Section 2-91 . 3 and
refers to Lobbyist Registration .
According to Mr . Ben Gaddis , President of the Hawaii County Bar
Association, the Lobbyist Registration law affects many members of
the bar who have contact with County agencies and boards on behalf of
their clients because, in order to comply with this ordinance , an
attorney will have to violate client confidentiality . This action
may subject the attorney to disciplinary action .
In light of this problem, the Hawaii County Bar Association has
endorsed Bill 148 , which would exempt attorneys representing their
clients before agencies and boards from the lobbyist registration
requirement .
Mr . Ben Tsukazaki , a Hilo attorney, testified in behalf of the
Hawaii County Bar Association. Mr . Tsukazaki explained to the
Committee that the primary purpose of the proposed ordinance is to
protect client confidentiality between attorney and client .
Councilmembers Russell Kokubun, Robert Herkes and James Dahlberg
questioned the necessity for the amendment . Committee Vice Chairman
Spencer Schutte suggested that the Bill be referred to the Council
for first reading and be referred back to Committee for further
discussion . Committee Chairman Takashi Domingo was instructed to
request an opinion from Corporation Counsel and Prosecuting Attorney
as to the legality of the proposed Bill .

of Bill 148 and recommends that it pass first reading and be referred
back to the Committee on Planning.
