HomeMy WebLinkAboutREP PC 097 03/11/1986 1984-1988 411 REPORT OF THE 111 COMMITTEE ON PLANNING DATE: March 11 , 1986 Re: Comm. 448 PLACE: Councilroom TIME: 1-:30 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 140 regarding the rezoning request of Wilfred Buddy Soares , Olaa Reservation Lots , Puna, Hawaii , TMK: 1-8-5: 96, reports as follows : This bill passed first reading on March 5 , 1986 and was referred to the Planning Committee for further review . The purpose of this bill is to change the district classification of a 49 .6-acre parcel from an Agricultural 20-acre (A-20a ) to an Agricultural 10-acre (A-10a) zoned district . The property fronts the North Kulani Road and is adjacent to the Olaa Scenic Lands subdivision. The lots in Olaa Scenic Lands is zoned Agriculture 5-acre . The applicant intends to subdivide the property into four lots , consisting of three 10-acre parcels and a 19 .6-acre parcel . The three 10-acre parcels will be conveyed to the applicant 's three married children while the 19 .6-acre lot will be retained by the applicant. All essential utilities and services , with the exception of water , are available to the property. Only one 5/8-inch meter will be available to the subject property due to the insufficient supply of water in this section of the Puna District . Although a sufficient volume of water is not available to the property, the Planning Commission is recommending approval of the application . The Planning Commission, in accord with its revised water policy, will recommend approval of a subdivision request if the intent is to convey the subdivided parcels to certain related individuals , even if water is not available . However , restrictive deed covenants shall be imposed allowing conveyance to a third party only if there is either : a . Water service to the site . b . A valid commitment for water service . c . A water catchment system that satisfies any County standard which may be adopted. It should be noted that even if the subject rezoning request is approved, a waterrequirement variance will still be required. The requested Agriculture 10-acre zoning conforms to the General Plan land use designation for the area . Only a portion of the property is considered "prime" by the Department of Agriculture ' s Agricultural Lands of Importance to the State of Hawaii classification system.
