Your Committee on Planning, to which was referred Bill No. 125
regarding the rezoning request of S. Kalani Schutte, Waikoekoe ,
Hamakua, Hawaii , TMK: 4-7-07 :39, reports as follows:
The purpose of this bill is to rezone approximately 73.4 acres of
land from an Agricultural 40-acre (A-40a) to an Agricultural 35-acre
(A-35a ) zoned district .
The property fronts the Hawaii Belt Road, approximately 7 ,000 feet
east of the Mud Lane-Hawaii Belt Road intersection .
The applicant plans to subdivide the property into two lots , with
each lot containing approximately 36 .72 acres . The applicant plans
to sell one of the lots to help finance improvement costs on the
other lot , which he plans to keep.
In his rezoning application, the applicant stated that the property
will continue to be used for grazing and added that restrictive
covenants may be imposed to guarantee agricultural use of the lots .
Condition (E) of the bill imposes such a condition .
The General Plan designates the area for "Intensive Agricultural"
uses . Restrictive covenants will continue to assure agricultural use
of the property.
Another policy of the General Plan states that "Agricultural land
shall be used as one form of open space or green belt . " The 35 acre
designation is still large enough to maintain the open space value of
the property.
All essential utilities and services , including water , are available
to accommodate the proposed development .

Your Committee on Planning is in accord with the intent and purpose
of Bill 125 and recommends that it pass first reading .
