Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 120 regarding the rezoning request of Douglas Dick , et al . , Kohala Estates Subdivision, North Kohala, Hawaii , TMK: 5-9-08:3 (20 .21 acres ) , reports as follows : The purpose of Bill No. 120 is to change the district classification of this 20-acre parcel from an Agriculture 20-acre (A-20a ) to an Agriculture 3-acre (A-3a) zoned district . The petitioners intend to subdivide the property into six lots with P P Y each lot being at least three acres in size . The property is owned by three individuals who intend to utilize at least one lot each for agricultural purposes and to . . sell one or two lots at market price and to use the revenue to make necessary infrastructure improvements and to make capital improvements on the remaining lots . " Each of the three owners have specific plans to use their lot or lots for agricultural purposes . The Kohala Estates Subdivision was created in 1971 and consists of lots ranging in size from 5 to 20 acres . A majority of the lots remain vacant; however , a few are being used for agricultural activities , grazing and single family residences . In 1983 the County Council granted a zone change to the developers of the Kohala Estates Subdivision for approximately 2,500 acres of land in the vicinity of Kohala Estates . Condition G of the change of zone ordinance required "That water for domestic , agricultural and fire protection purposes shall be provided to all lots of the existing Kohala Estates Subdivision Phase I simultaneously with the supply of water to any other phase of the development. " These newly rezoned parcels plus lands already zoned A-20a comprise the Kohala Ranch Subdivision. The developers of Kohala Ranch have issued a bond to the County to guarantee completion of improvements , including water . The Bond Agreement requires completion of improvements on or before December 31 , 1988 . PC REPORT No . 75 ADOPTED : JAN 22 19k PC-75 Page 2 January 13 , 1986 In view of the fact that there is no public water system to service Kohala Estates , the petitioners have entered into a "Water Agreement" with Kohala Joint Venture, the developers of Kohala Ranch. Under the agreement, Kohala Joint Venture will provide the petitioner a water commitment of 6,000 gallons of water per day. However , water is not immediately available. Depending on the completion date for the construction of the transmission lines and reservoirs for the water system, water may not be available for the petitioners ' development until July 1, 1987 . Condition A of Bill No. 120 states , "The zoning of the property shall be effective only after water is made available to the property from either the Kohala Joint Venture 's private water system or a public water system. The petitioners shall also show proof of the availability of water to accommodate the proposed development; (B) no subdivision of any portion of the land shall occur unless and until Condition A has been complied with. " The General Plan designates the .property as "Extensive Agriculture . " The requested A-3a zoning conforms to the General Plan land use designation for the area . The requested agricultural designation is also consistent with the Kohala Community Development Plan which designates the area for "Small Scale Agriculture.
