HomeMy WebLinkAboutREP PC 063 10/22/1985 1984-1988 c;- • REPORT OF THE COMMITTEE ON PLANNING DATE: October 22, 1985 Re: Comm. 311 PLACE: Councilroom TIME: 1:30 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii Your Committee on Planning, to which was referred Bill No. 88 regarding the rezoning request of Anna Keanaaina , et al . , Kalaoa, North Kona, TMK: 7-3-05:9, reports as follows: The purpose of this bill is to rezone approximately 35 .49 acres of land from an unplanned (U) to an Agricultural 3-acre (A-3a) zoned district . The property is located along the makai side of the Hawaii Belt Road adjacent to Kona Acres subdivision. According to the Planning Department, Norman Keanaaina submitted a similar rezoning request for the subject property in 1982. The request was denied by the Planning Director on May 10 , 1983 , due to the lack of water . Mr . Keanaaina subsequently filed an appeal; however , the appeal was withdrawn in January 1984, at the request of Mr . Keanaaina . The present petitioners intend to subdivide the property into ten lots , with each lot containing a minimum of three acres . The ten lots will be distributed among the ten legal heirs to the property. All essential utilities and services, with the exception of water, are available to the property. Only one 5/8-inch meter will be available to the subject property due to the current water situation in Kona . In reference to the application, the Department of Water Supply stated that "Since this is for division among family members only with no intention of building immediately, we have no objections for this rezoning to be approved. " The Planning Department has stated that it has also "reconsidered its water policy relative to rezoning and subdivision requests . On a case-by-case basis , proposals which are submitted in order to divide land among related individuals (such as parents and their children or amongst siblings ) may now be considered for approval . As a condition of approval , however , restrictive deed covenants shall be imposed allowing conveyance to a third party only if there is either: a) a valid commitment for water service, (b) water service to the site , or c) . a water catchment system that satisfies any County standards which may be adopted for such a system. " PC REPORT NOS 63 ADOPTED : Nov 61905 h L • • • PC-- 63 Page 2 October 22, 1985 It should be noted, however , that even if the subject rezoning request is approved, the applicant will still be required to secure a variance from the subdivision code 's water requirement . The General Plan designates the property as Extensive Agricultural and Alternate Urban Expansion (AUE) . The requested rezoning conforms to the General Plan land use designation for the area. The Kona Regional Plan designates the property as Residential-Agricultural , 2 to 3 acres . Your Committee on Planning is in accord with the intent and purpose of Bill No . 88 and recommends that it pass first reading .
