Your Committee on Planning, to which was referred Bill No. 81
regarding the rezoningrequest of James Lee and Irene Croft,

North Kona, Hawaii , TMK: 7-8-07 :64 & 70, reports as follows:
Bill No. 81 passed first reading on September 18, 1985 and was
referred back to the Planning Committee for further discussion and
action.
The purpose of this bill is to rezone approximately 32, 926 square
feet of land from Single Family Residential - 7 ,500 square feet
(RS-7.5 ) to Village Commercial - 7,500 square feet (CV-7 .5) .
The property is located along the makai side of Mamalahoa Highway,
approximately 180 feet from the former Aloha Theater in
Kainaliu Village. The petitioners intend to renovate the existing
single-family dwelling on parcel 64 and convert it into a retail
nursery.
Councilman Herkes moved that portions of condition F of Bill No. 81
be amended as follows : "These improvements may be deferred either
until [a more intensive commercial use (other than the proposed
retail plant nursery) is established on the property or within three
years from the effective date of the zone change, whichever occurs
first .] an improvement district is authorized for curbs, gutters and
sidewalks (whereupon the property owner shall automatically
participate) or when the adjoining properties on the southern or
northern boundaries on Mamalahoa Highway are required to install
curbs, gutters. and sidewalks . These improvements would then go in
concurrently with the adjoining property. (Note: Brackets and
underscoring are used in this committee report for information only
and will not appear in Draft 3 of Bill No. 81. )
Councilman Herkes ° motion was carried unanimously.
