Your Committee on Planning, to which was referred Bill No . 65
regarding the rezoning request of Mr . & Mrs . Claudio Icari ,
Kukuau 2nd, South Hilo, TMK: 2-5-51:5 , reports as follows:
Bill No . 65 passed first reading on Jugust 7,. 198.5, and was referred
back to the Committee on Planning for further discussion and
consideration.
The purpose of this bill is to rezone a 38,305 square foot parcel
from Agriculture 20-acre (A-20a ) to Single Family Residential
10 ,000 square foot (RS-10 ) .
The RS-10 designation will enable the applicants to subdivide the
property into three residential lots . One lot will contain their
residence . They will retain this lot and convey the remaining two
lots to their two children .
Condition (C) of Bill No . 65 requires the applicants to construct a
single family dwelling on one of the two vacant lots within three
years from the date of receipt of final subdivision approval .
Your Committee believes that imposing building requirements on a
subdivision that will be producing only two vacant lots is definitely
unwarranted. Therefore , your Committee has amended Bill No . 65 by
eliminating condition (C) in its entirety.
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 65, as amended, and recommends that it pass second
reading .
