Your Committee on Planning, to which was referred Bill No . 61
regarding the rezoning request of Gilbert McConnell , Kaauhuhu ,
North Kohala, TMK: 5-5-08 : 3 , reports as follows:
Bill No . 61 passed first reading on Auiu t,7,, .1985, and was referred
back to the Committee on Planning for further discussion and
consideration.
The purpose of this bill is to rezone approximately five acres of
land from Agriculture 5-acre (A-5a ) to Residential Agriculture 1-acre
(RA-la ) . The property is to be subdivided into five 1-acre lots .
After the subdivision is completed, the McConnell ' s residence and a
building for the Kingdom Hall Church will each occupy one lot,
leaving three vacant lots .
Condition (C) of Bill No . 61 requires the McConnells to construct a
single family dwelling on one of the three vacant lots within three
years from the date of receipt of final subdivision approval .
Your Committee believes that imposing building requirements on a
subdivision that will be producing only three vacant lots is totally
without merit . Therefore , your Committee has amended Bill No . 61 by
eliminating condition (C) in its entirety.
Your Committee on Planning is in accord with the intent and purpose
of draft two of Bill No . 61 and recommends that it pass second
reading.
