Your Committee on Planning to which was referred Bill No . 31,
regarding the rezoning request of George Fontes, Kapena, North Hilo,
TMK: 3-2-02:portion of 41, reports as follows:
The proposed legislative bill changes the district classification of
approximately 2. 3 acres of land from an Agricultural 20-acre (A-20a)
to an Agricultural 1-acre (A-la) zoned district and approximately
8 .5 acres of land from an Agricultural 20-acre (A-20a) to an
Agricultural 5-acre (A-5a) zoned district at Ninole, Kapena,
North Hilo. The property is located on the mauka side of Mamalahoa
Highway, across from the Ninole Post Office.
The petitioner 's subdivision plans call for the creation of three
parcels . Two of the parcels will each be approximately one acre in
size and the remaining parcel will be approximately 8 .5 acres in size.
The 8 .5 acre parcel will be rezoned A-5a. Therefore, this parcel
will not be subdividable without further rezoning action.
The General Plan Land Use Pattern Allocation Map designation for the
proposed rezoning area is Low Density Urban, which may allow
residential uses at a maximum density of four units per acre .
The redesignation of this particular area of Ninole to -the proposed
A-la zoned district may not comply with the General Plan ' s land use
designation; however , it may be more appropriate with respect to the
existing form and character of Ninole Village. The Village of Ninole
can be characterized as Rural-Residential. The majority of
properties in Ninole are approximately one acre in size and scattered
along Mamalahoa Highway.
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 31 and recommends th t it4- s pass first reading .
