Your Committee on Planning to which was referred Bill No . 19
regarding the rezoning request of Dr . Ernest Bade ,
TMK: 2-5-06 :portion of parcel 30 , reports as follows:
The purpose of this bill is to change the district classification
from an Agricultural 5-acre (A-5a) to an Agricultural 3-acre (A-3a)
zoned district at Ponahawai , South Hilo. The property is located
along the makai side of Akolea Road, approximately 1 ,445 feet north
of Akolea Plantation Subdivision .
The petitioner is requesting the change of zone in order to
subdivide a 3-acre portion of the existing 21 .5731 acre property .
The petitioner states that "such a change would allow me to transfer
to my son that portion of the west .end of my lot that is suitable
for farming. There are approximately 2-1/2 acres facing Akolea Road
that are tillable , the adjacent land being untillable rock . I plan
to build a residence on the rocky portion, adjacent to the tillable'
land, so do not wish to transfer to my son the 5-acre minimum S
allowed under existing zoning. "
The Department of Agriculture stated: "According to the application,
the applicant seeks to rezone the parcel to permit a subdivision of
the parcel into two lots of 3 .0001 (Lot A) and 18 .573 (Lot B) acres
each. The parcel is composed of approximately one-half 'Prime '
agricultural land according to the Agricultural Lands of Importance
to the State of Hawaii (ALISH) system. These lands are found along
Akolea Road and along the eastern portion of this parcel , and
include a portion of Lot A. The remainder of the parcel is not
classified according to the ALISH system. "
The requested zone change conforms to the Land Use Pattern
Allocation Guide (LUPAG) map.
Given the existing A-5a zoning for the 21.573 acre parcel , the
petitioner could subdivide the property into four lots . The proposed
A-3a zoning designation would allow the petitioner to create one
3-acre lot . The remaining , approximately 18 acres would still retain
the A-5a zoning designation . As such , approval of this change of
zone request will not increase the overall density of the subject
area . Even if this proposed A-3a zoning designation is approved,
the petitioner would still be limited to a maximum of four lots .
