Your Committee on Planning, to which was referred 'ill No . 16
regarding an amendment to Condition E of Change of Zone Ordinance
No . 790 , TMK: 7-5-09:39 (Oku Resort House, Inc . ) reports as follows:
The amendment requests that improvements required under Condition E
be deferred to December 31, 1987 . Condition E requires Oku Resort
House, Inc . to install curbs , gutters and sidewalks along the
frontage of the property prior to taking occupancy.
Oku Resort House is requesting this amendment to allow them time to
operate their restaurant and generate sufficient cash flow to pay for
the improvements required under Condition E.
Councilpersons Jitchaku and Kokubun raised questions in reference to
liability. Councilman Herkes stated that a short sidewalk jutting
out of the ground would be more of a liability.
Councilman Herkes recommended that the Okus be required to install
the improvements only upon such time as development occurs on either
of the adjoining property, or upon demand by the County Council ,
whichever occurs first. As such , your committee has amended the bill
accordingly .
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 16 , Draft 2 , and recommends that it pass second reading .
