Your Committee on Planning, to which was referred Bill No . 12
regarding an amendment to Change of Zone Ordinance No. 341, Hamakua
Sugar Company, Inc. , TMK: 4-5-10 : 1, 2, portion of 31, and 82,
reports as follows :
The purpose of this bill is to amend Ordinance No . 341 which rezoned
approximately 115 acres of land from Agricultural 40-acre (A-40a ) and
Agricultural 5-acre (A-5a) to a Single Family Residential - 10 ,000
square foot (RS-10 ) zoned district in the land divisions of Paalaea ,
Papaanui , Haina and Namoku, Hamakua, Hawaii . This bill amends the
conditions of Ordinance No. 341 .
The intent of the initial zone change by Hamakua Sugar Company,
Inc. ' s predecessor was to provide housing for the employees and
pensioners, and to provide residential lots for land exchange with
other independent cane growers in the area. Since then , plans have
shifted from that of providing housing for its employees to that of
providing surplus lands to accommodate its land exchange program.
Retention of the lands within the RS zoned district allows housing to
be provided for residents in the immediate area .
The conditions of zoning to Ordinance No . 341 have been deleted in
its entirety and have been replaced with conditions which reflect the
following:
1 . The property be rezoned into three increments , the second
and third increment to be zoned after the construction of
single family dwellings on 25 per cent of the proposed lots
of the first increment . In lieu of the actual construction ,
the petitioner may enter into an agreement bond with the
Planning Department and the Corporation Counsel to assure
the county that the dwelling will be constructed within a
given period .
2 . The necessary drainage and channelized intersection
improvements be developed concurrently with the area
within the second zoning increment .

The Council at its February 8, 1985, meeting adopted the following
motion on Planning Committee Report No. 16:
Your Committee on Planning is in accord with the intent and
purpose of Bill No. 12 and recommends that it pass first
reading.
