Your Committee on Planning, to which was referred Bill No . 11 ,
regarding the rezoning request of Laupahoehoe Heights Associates ,
TMK: 3-5-04 : 25 , reports as follows:
The purpose of this bill is to change the district classification
from a Single Family Residential - 10 ,000 square foot (RS-10 ) to a
Residential-Agricultural - 1-acre (RA-la ) zoned district at Kihalani
Homestead, North Hilo, Hawaii .
The petitioner intends to subdivide the property into four lots: two
2. 3 acre lots and two 2 .8 acre lots . The intent is to provide
residential estates or residential/farm lots .
Technically, the petitioner 's proposal could be accommodated within
the current RS-10 zoned district . However , when the subject property
was rezoned in April , 1974 , from Agricultural 20-acre to Single
Family Residential 10 ,000 square foot, Condition A of Ordinance 28
required that "the area be zoned in two ( 2 ) increments . The first
increment shall consist of 26 lots and the second increment the
remaining lots. "
The petitioner will not be able to fulfill the conditions of this
ordinance . He will have to either amend the ordinance or submit a
rezoning application, which he has done .
The downzoning of the property will substantially decrease the
density of the property and greatly lessen its impact on existing
infrastructure in the area .
The requested zone change conforms to the Genral Plan Land Use
Pattern Allocation Guide Map which designates the area for Low
Density Urban Development .
