Your Committee on Planning to which was referred Bill No. 9 regarding
the return of a road improvement deposit of Dr . Victor Jensen' s
change of zone Ordinance 519 , TMK: 6-5-07 :36 and 76 , reports as
follows:
The purpose of this bill is to amend Condition E of Ordinance 519 , by
requiring automatic participation should an Improvement District or
similar arrangements be initiated for Opelo Road, in lieu of the road
and drainage improvement fee .
The applicant requested the return of the $4,000 road improvement
deposit required by Condition E of Ordinance 519 . The request was
initiated since the funds remained idle; however , since then, the
Department of Public Works initiated plans for drainage and road
improvements .
Your committee has held previous discussion on this matter on
June 13 , 1984 , and September 11 , 1984. Your committee felt that the
$4,000 deposit posed an undue burden upon the applicant since he was
required to install a fire hydrant and water mains .
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 9 and recommends that it pass first reading .
