Your Committee on Planning, to which was referred Bill No. 78, reports as follows:
Bill No. 78, transmitted by Mayor Harry Kim, via Communication No. 560, dated October 19,
2017, amends Section 25-8-11 (Lalamilo-Pu`ukapu Zone Map), Article 8, Chapter 25 (Zoning)
of the Hawai`i County Code.1983 (2016 edition, as amended), by changing the District
Classification from Agricultural—one acre (A-1a) to Single-Family Residential—20,000 square
feet (RS-20) at Waimea Homesteads, South Kohala, Hawai`i, covered by Tax Map
Key: 6-5-004:049 (Applicant: Kathleen L. Brilhante) (Area: 1.166 acre).
Mayor Kim forwarded the Leeward Planning Commission's favorable recommendation for this
change of zone, which would allow the applicant to subdivide the property into two lots. The
applicant will continue to live in her current residence and the new lot will be conveyed to a
family member to build a residence.
Planning Consultant Zendo Kern appeared together with the applicant, Kathleen Brilhante.
Mr. Kern gave a brief overview of the project, and explained that this is a simple rezoning
request in Waimea Homesteads that meets all criteria as to the Land Use Pattern Allocation
Guide, water, and other basics. Mr. Kern also stated that there were recent rezonings nearby, and
that the zoning in surrounding areas is RS-10, RS-15 and one acre.
Council Member Tim Richards stated that he is very familiar with this area and the area
surrounding it, then relayed that he was in favor of this simple and reasonable request.
Council Member Lee Loy inquired as to the applicant's agreement with the conditions of
approval that were attached, to which Mr. Kern replied in the affirmative.
Council Member Kanuha asked if there was opposition from neighboring residents, to which
Mr. Kern replied that there were none.
The vote was then taken on the motion to move this measure to council with a positive
recommendation and passed with nine"ayes."

Your Committee on Planning is in accord with the purpose and intent of Bill No. 78, and
recommends its passage on first reading.
