BILLS FOR The Chair directed the Committee to proceed to the next order of business, ORDINANCES: Bills for Ordinances. PC -15 November 14, 2017 Bill 78: AMENDS SECTION 25-8-11 (LALAMILO-PU'UKAPU ZONE MAP), ARTICLE 8, CHAPTER 25 (ZONING) OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS AMENDED), BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL — ONE ACRE (A -la) TO SINGLE-FAMILY RESIDENTIAL — 20,000 SQUARE FEET (RS -20) AT WAIMEA HOMESTEADS, SOUTH KOHALA, HAWAII, COVERED BY TAX MAP KEY: 6-5-004:049 (Applicant: Kathleen L. Brilhante) (Area: 1.166 acre) The Leeward Planning Commission forwards its favorable recommendation for this change of zone, which would allow the applicant to subdivide the property into two lots. The applicant will continue to live in her current residence and the new lot will be conveyed to a family member to build a residence. Reference: Comm. 560 Intr. by: Ms. Eoff (B/R) Motion to Approve: Mr. Richards moved to recommend passage of Bill 78 on first reading. Seconded by Ms. Lee Loy. CHR. EOFF: We have Mr. Zendo Kern in the audience. Can you please come forward, as well as the applicant, Ms. Brilhante? (Note: At this time, Planning Consultant Zendo Kern and applicant Kathleen L. Brilhante came forward to address the members of the Committee.) CHR. EOFF: And if you wouldn't mind just introduce yourselves one more time and I believe you have some background information to provide for us. MR. KERN: Yes thank you. Good morning Madam Chair and members of the Planning Committee, I'm Zendo Kern and sitting next to me is Ms. Brilhante, the applicant. Do you want to introduce yourself just so you're on record? MS. BRILHANTE: I'm Kathleen Brilhante. MR. KERN: So thank you very much. This is a very simple rezoning request in the Waimea Homesteads area. It meets all the criteria as far as County LUPAG (Land Use Pattern Allocation Guide) map, infrastructure, water, and all the basics. There's really nothing controversial or even unique about it. There was a recent rezoning that was done down the street about a few years ago and other areas in that general proximity, there's some zonings of RS -10, RS -15, some one -acre, so it's kind of in an area that's transitioning, if you will, to medium density urban. So we're here to answer any questions that you have and I did ask Ms. Brilhante to be present here for this, even though I'll be answering the majority of the questions here. Page 2 PC -15 November 14, 2017 CHR. EOFF: Yes, thank you for being here. I'm going to turn the floor over to Mr. Richards, this is in his district. MR. RICHARDS: Thank you, Chair and thank you, Ms. Brilhante for coming today. I just want to say I know this area quite well and I think you were great in your articulation of it. This is a very simple and very reasonable request. I know the area quite well and it folds right into what's going on. I'm very well aware of the other one that was subdivided very recently, I know the parties there and so this all makes sense. I ask my fellow Committee Members to vote for moving this forward with a positive recommendation. CHR. EOFF: Okay, thank you, any other comments, Council Members? Ms. Lee Loy. MS. LEE LOY: Thank you, Chair, just a real quick question. I know you, as the applicant, get asked this, there are a number of conditions of approval attached to this zoning ordinance, Bill 78, and I just want to understand that you folks agree and accept the conditions of approval as identified in Bill 78. They're conditions A through O. MR. KERN: Yeah, we reviewed these. We see no problems with it; they're straightforward and pretty much in alignment with majority of a rezone. So yeah, we have no problems with those and we accept those conditions. MS. LEE LOY: Thank you, I yield. CHR. EOFF: Okay, thank you, any other comments? Mr. Kanuha. MR. KANUHA: Thank you. It seems pretty—definitely going to vote for this think Mr. Richards said it clearly, but was there any residents neighboring this area that was in opposition? I hadn't seen any in the packet that they gave me, unless I missed something. MR. KERN: No, we sent out the Notice to Surrounding Property Owners as we're supposed to. We sent out two notices. I have not received any calls, letters of opposition directly to me or when we were at the Planning Commission wasn't there or at the Planning Department. Ms. Brilhante did let me know that the neighbor mauka of her did call, just to basically touch base on it, did not say they were against it, just kind of a friendly neighbor, touch base, that's it. It's been very uncontroversial. MR. KANUHA: Yeah. Okay, thank you. CHR. EOFF: Okay thank you, any other questions or comments? Seeing none, well thank you for being here and I did look at the minutes from the Planning Page 3 PC -15 November 14, 2017 Commission meeting and it does seem like it was not controversial in any way and it was well received. MR. KERN: Yes, it was. Thank you all so very much. CHR. EOFF: Thank you and I'll take a vote. All in favor of moving Bill 78 to Council with a positive recommendation please say "aye." Vote on Bill 78: The motion to recommend passage of Bill 78 on first (Approved) reading was carried by the following voice vote: Ayes: Committee Members Chung, David, Kanuha, Lee Loy, O'Hara, Poindexter, Richards, Ruggles, and Chair Eoff — 9. Noes: None. Absent: None. Excused: None. CHR. EOFF: Okay, thank you. ADJOURN- There being no further business, at 9:15 a.m., Ms. Poindexter moved to adjourn MENT: the meeting.
