Resolution Adopting the American with Disabilities Act (ADA) Self- Evaluation and Transition Plan for streets and sidewalks. We further request that the resolution be waived past committee meetings. The subject matter of this resolution has also been discussed with the County Council during executive session previously. Thank you very much. Yours sincerely, Q om:/:: Corporation Counsel B y STEVEN CHRISTENSEN Deputy Corporation Counsel SC:pc sccomm\ADA ltr to arakaki 5 -99 Enclosure No. 3 Comm• File No G ©k- PvvPc Ref, To: ReL Dau ,»1 Z � I COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 95 9 RESOLUTION ADOPTING THE AMERICANS WITH DISABILITIES ACT (ADA) SELF - EVALUATION AND TRANSITION PLAN FOR STREETS AND SIDEWALKS BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: WHEREAS, 28 C.F.R. § §35.105 AND 35.150 call for the County of Hawaii to perform a Self- Evaluation of its current services, policies, and practices that do not, or may not, meet the requirements of 28 C.F.R., Part 35, and to prepare a Transition Plan setting forth the steps necessary to complete or augment changes to achieve program accessibility; and WHEREAS, the Settlement Agreement Release and Order filed in Alexa Russell, et al. vs. County of Hawaii, USDC Civil No. 97- 00379DAE on October 2, 1997, Requires the County to adopt a Self- Evaluation and Transition Plan by July 2, 1999; and WHEREAS, the County of Hawaii through its consultant Wilson Okamoto & Associates, Inc. and its subconsultant, Hecker Design Ltd., has completed the Self - Evaluation Plan, a copy of which is attached hereto as Exhibit "A" and a Transition Plan, a copy of which is attached hereto as Exhibit `B." NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Self- Evaluation and Transition Plan are hereby adopted. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii provide a copy of this Resolution to the Mayor of the County of Hawaii, the Director of Parks and Recreation, Corporation Counsel and the County's ADA Coordinator.
