Subject: Annual Progress Report ~,rrr• ~~_lc•15 This is to acknowledge receipt of your annual progress report dated April 12, 1999, submitted in compliance with Condition L of the above-referenced ordinance. Thank you for complying with the annual report requirement. Your progress report indicated that the Trust acknowledges that a time extension to Condition C needs to be submitted, as the condition should have been complied with by May 24, 1995. It is our understanding that the Trust intends to submit a new time extension request at such time as a final right-of--way agreement on the Queen Kaahumanu Z:•Tighway is reached with the State Department of Transportation. According to your report, the agreement is expected to be finalized sometime this year. Condition C states: "C. Final Plan Approval of the development shall be secured from the Planning Department within one year from the date of Final Subdivision approval. To assure adequate time for plan approval review and in accordance with Chapter 25- 244 (Zoning Code), plans shall be submitted a minimum of forty-five days prior to the date by which plan approval must be secured. Plans shall indicate internal driveway circulation with the adjacent Kona Coast Shopping Center." Comm. No. ~ I File No. ZN6 K~ Ref• To: &ef. Date MAY 2 $ 1999 Mr. James R. Bell Belt Collins Page 2 May 28, 1999 In reviewing your file, we find that an administrative extension of time until May 24, 1995 to secure Final Plan Approval was grained on Apri122, 1994. We noted in our letters dated May 4, 1995 and March 31, 1998 that a request for an additional extension of time to comply with Condition C would be processed through this office and the Planning Commission. Further, by letter dated October 9, 1997, we noted that we were awaiting the necessary paperwork to process your request for an additional extension of time. However, your letter dated October 17, 1997 and the subject annual report states that the request for a time extension will be considered after the Trust reaches an agreement wish the State Department of Transportation. Inasmuch as Condition C should have been complied with by May 24, 1995, a time extension is in order and we encourage you to submit a request for an extension of time to Condition C. The request for a time extension to Condition C, together with the $250 filing fee, original and twenty copies of the request should be submitted to this office. A public hearing to consider your request will be held within 120 days. After such a hearing is conducted, the request and the Commission's recommendation will be forwarded to the County Council. As a reminder, you are required to comply with all conditions as stated in the above-referenced ordinance within their appropriate timetables. Your next annual progress report will be due on or before March 21, 2000. Should you have any questions, please call Phyllis Fujimoto or Susan Gagorik of this office at 961-8288.
