Okura, Esq., from Planning Director Norman K. Hayashi, dated April 30, 1991, acknowledging receipt of his letter of April 1, 1991 informing that an easement was granted to Harue Matsumoto to allow access to the subject properties along a private roadway located to the south and that it would not be necessary to relocate the temporary barricade, which is presently located at the properties' northern boundaries adjacent to Kona Coast View Subdivision, to provide access to the subject properties. States Condition D of Ordinance 89 30 states that a temporary barricade be placed along the southern boundary of the subject properties at the southern end of Holu Street extension, thus, while an easement has been granted to allow for access to the subject properties from Keokeo Street, that the original intent of the condition requires that access to the subject PC-55 Page 2 May 22, 1991 (Comm. 2518) properties be through the Kona Coast View Subdivision (Cont'd) and Holu Street. Comm. 2543: From Joe Almeida, General Manager, Kona Palisades Estates Community Association, dated May 7, 1991, informing, in accordance with a condition contained in Ordinance 89 30 (rezoning application of Sanford Okura/Harue Matsumoto), that a temporary traffic barricade shall be installed at the southern end of Holu Street, thereby prohibiting through traffic and that the barricade shall be removed as soon as a connector road, between Mamalahoa Highway and Queen Kaahumanu Highway, is constructed, that he has personally inspected the southern end of Holu Street and confirms that a satisfactory barricade has been erected. On behalf of the Board of Directors of their Association, he conveys satisfaction that such condition has been adhered to adequately. Comm. 2537: TREE ON BISHOP MUSEUM PROPERTY IN CAPTAIN OOK Copy of letter to Planning Director Norman K. Hayashi from W. Donald Duckworth, President and Director of Bishop Museum, dated May 7, 1991, requesting that a large specimen of Spondias dulcis, commonly known as the "wi" tree, located in Bishop Museum's Amy Greenwell Ethnobotanical Garden in Captain Cook, which was designated an Exceptional Tree by the Council in 1984, be removed from the County's Exceptional Trees list. States the tree constitutes a hazard due to extensive decay and should be cut down. Informs, unless they are allowed to cut the tree down, the legal and financial responsibility for any damage caused by the tree will belong entirely to the County and the agencies concerned, whether the damage is caused by the direct fall of the tree or any of its parts, or by the spread of pathogens into their collection. Comm. 2538: CHANGE OF ZONE ORDINANCE NO. 84 11 APPLICANT: PACIFIC HAWAIIAN, LTD. REQUEST: A-la TO CN-40 TMK: 2-3-37: O1. PONAHAWAI, S. HILO Copy of letter to Pacific Hawaiian, Ltd., from Planning Director Norman K. Hayashi, dated May 9, 1991, requesting that while it has been in excess of seven years since the approval of Change of Zone Ordinance No. 80 11, they have yet to secure Final Plan Approval of the proposed development, much less commence construction in compliance with Condition C which PC-55 Page 3 May 22, 1991 Comm. 2538: states, "construction shall commence within one (1) (Cont'd) year from the date of receipt of final Plan Approval and shall be completed within two (2) years thereafter;". Informs unless he hears from them within thirty (30) days of receipt of his certified letter, he may initiate rezoning of the area to its original or more appropriate designation pursuant to Condition H of the subject ordinance. Comm. 2544: SENATE RESOLUTION NO. 172 From T. David Woo, Jr., Clerk of the Senate, transmitting a copy of Senate Resolution No. 172, requesting the Office of State Planning to conduct a comprehensive study of the cumulative impact of golf course development on Oahu, which was adopted by the Senate at its Regular Session of 1991. Comm. 2557: APPOINTMENT - PLANNING COMMISSION From Mayor Lorraine R. Inouye, dated May 14, 1991, submitting for confirmation the following appointment to the Planning Commission: Lance K. Matsumura, an independent from Kona, to serve until December 31, 1991, filling the unexpired term of Fred Y. Fujimoto, who resigned due to health reasons. Comm. 2568: REQUEST: TIME EXTENSION TO CONDITION B CHANGE OF ZONE ORDINANCE NO. 90 08 (R 655) APPLICANT: ELWIN F. HUSSEY TMK: 5-9-07:07 Copy of letter to Susan Wells Fischer, from Planning Director Norman K. Hayashi, dated May 13, 1991, acknowledging receipt of her letter dated April 8, 1991, providing additional information relative to her previous request for an extension of time in which to comply with Condition B (submit subdivision plans) of Ordinance No. 90 O8; also, receipt of her letter of authorization recognizing her as the applicant's representative. Further, informs that an extension of time until February 13, 1992 in which to submit preliminary subdivision plans in compliance with Condition B, is granted. States, should the applicant require an additional extension of time, the request, accompanied by a $100 filing fee, shall be submitted to his office for consideration by the Council.
