Maxey of Volcano, to the Hawaii County Tax Board of Review. Reappointment to this specific entity is permitted as described in the attached opinion. Mrs. Maxey is a life-time resident of Hawaii and, since 1985, has been an owner/manager of a bed and breakfast business. She is active with the Volcano Community Association, the Volcano Arts Center, and the Lanikai Community Association. She is a Democrat. If approved, Mrs. Maxey will serve a term to end December 31, 2001. Should the Council need further information regarding this submission, you may call me at your convenience. WURDEMAN/~~ Corporation Counse SUBJECT: BOARDS AND COMMISSIONS (Elioibility) In your inguiry of March 20, 1996, you asked about the applicability of the eligibility requirements found in Section 13-Y of the Charter to members of the Taa Board of Review. The Taa Board of Review, originally created by State Law, is now established under the authority of an ordinance, HCC §19-96. The Charter, 13-4, in providing various qualifications for membership, specifically limits itself to ..boards and commissions specifically established by this Charter..." As a general rule., regulations declaring qualifications for office are liberally construed, while those establishing disqualifications are to be strictly construed. McQuillin, Mltniciaal Corporations, §12-58. Accordingly, we are of the opinicn that the limitations that you cite, particularly the one barring reappointment, do not apply to members of the Taa Board of Review.
