Re: Accept Payment of In-lieu Fee
On June 19, 2001, the Hawai`i County Housing Agency passed Resolution No. 123
approving payment of in-lieu fees totaling $94,400 to satisfy condition "L" of Ordinance
98-66 for the development of up to 200 units at Puapua'a 1st and 2nd, in North Kona,
Hawai`i. The owner/developer made partial payments of$23,128 on January 22, 2007
and $23,600 on September 10, 2015.
Enclosed is a resolution to accept the $23,600 in-lieu fee payment from Wainani 42 LLC
to satisfy condition "L" as indicated above. If there are any questions, please do not

Please accept the corrected documents to prepare a resolution accepting payment of in-lieu fee in the
amount of$23,600 by Wainani 42 LLC, to partially satisfy condition "L" or Ordinance No. 98-66.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
On June 19, 2001 Hawaii County Housing Agency approved Resolution 123 approving in-lieu fees in the
amount of$94,400 by Owner/Developer David De Luz, Sr. to satisfy Condition (L) of Ordinance No. 98-66.
January 22, 2007, Wainani 42 LLC'paid partial payment of$23,128.
September 10, 2015, Wainani 42 LLC paid partial payment of$23,600.
