Re: Accept Payment of In-lieu Fee
In accordance with an Affordable Housing Agreement dated February 18, 1988, the
developer of a resort hotel in Ka`upulehu, North Kona agreed to pay in-lieu fees totaling
$100,000 for eight required affordable housing units. The developer paid $50,000 on
February 4, 1988. •
Enclosed is a resolution to accept an additional $50,000 in-lieu fee payment from KW
KONA INVESTORS, LLC to satisfy the conditions of the Affordable Housing
Agreement as indicated above. If there are any questions, please do not hesitate to call •

A. REQUEST:
Prepare a resolution accepting payment of in-lieu fee in the amount of$50,000.00 by KW KONA
INVESTORS, LLC to satisfy condition "B" of Ordinance No. 87-113.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
In accordance with the affordable housing agreement dated February 18, 1988, the developer paid a
$50,000 in-lieu fee to satisfy condition "B" of Ordinance No. 87-113
Februrary 4, 1988, developer paid partial in-lieu payment of$50,000.
January 4, 2017, developer paid $50,000 in-lieu fee.
