Your Committee on Public Works and Parks and Recreation,to which was referred Bill No. 104,
reports as follows:
Bill No. 104, transmitted by Council Member Maile David, via.Communication 731 dated
January 12, 2018, amends Chapter 2, Article 9, Section 2-40, and Chapter 27,
Article 3, Section 27- 16, of the Hawai`i County Code 1983 (2016 Edition, as amended), relating
to floodplain management.
The purpose of this bill is to update the Code by adding floodplain management to the duties
and functions of the Department of Public Works and to establish a requirement that the County
Council be notified of proposed changes to special flood hazard areas. The notification requirement
affords the public an opportunity to review and comment upon proposed changes to flood maps
that may affect risk premium rates and floodplain management requirements.
There was considerable public testimony in support of this ordinance. Several Council Members were in
strong support for the public review process being included in the County Code.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and intent of
Bill 104, and recommends its passage on first reading.
