AN ORDINANCE NAMING A COUNTY PARK WITHIN ALI`I KAI SUBDIVISION, SITUATED AT TAX MAP KEY NO. (3)7-6-19:034, AND AMENDING CHAPTER 15, ARTICLE 8, SECTION 15-68.1 OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO THE PARKS AND RECREATIONAL FACILITY SCHEDULE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to officially name the County park situated at tax map key no. (3)7-6-019:034, within Alii Kai Subdivision, pursuant to chapter 15, article 8, section 15-68, Hawaii County Code 1983 (2016 Edition, as amended), which provides that all County parks and recreational facilities shall be named by ordinance and included in the parks and recreational facilities schedule, codified as section 15-68.1. Alii Kai, Inc., donated this real property to the County of Hawaii on December 3, 1997, via Resolution No. 178-97 for the purpose of developing a park. The park was developed and opened for public use on May 12, 2016. Section 15-67(a)(2)(A) of the Hawaii County Code 1983 (2016 Edition, as amended), provides that a park may be "named for its neighborhood, community, region, district or other identifying geographical location." "Ah' i Kai Park" is the name that has been historically accepted and geographically identifies the location where this park is located. The area dedicated to and accepted by the County of Hawaii in Resolution No. 178-97, is hereby named "Ah' i Kai Park". SECTION 2. Chapter 15, article 8, section 15-68.1 of the Hawaii County Code 1983 (2016 Edition, as amended), the parks and recreational facility schedule, is amended by adding a new park listing to the "Kona" section to be appropriately inserted and to read as follows: "Ali`i Kai Park" SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 5. This ordinance shall take effect upon its approval.
