RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER
INTO AN AGREEMENT WITH THE UNITED STATES DEPARTMENT OF
THE ARMY, PURSUANT TO HRS § 46-7, FOR THE COUNTY OF
HAWAII TO SHARE COSTS FOR A WAIAKEA-PALAI FLOOD RISK
MANAGEMENT FEASIBILITY STUDY.
WHEREAS, the.United.States Congress has authorized the United States
Department of the Army ("Army") Corps of Engineers to conduct studies of flood
damage reduction pursuantto the authority provided by Section 205 of the Flood
Control Act of 1948 (Public Law 80-858), as amended; and
WHEREAS, pursuant to that authority, the Army and County entered a feasibility
cost sharing agreement dated March 23, 2004, and amended.March 23, 2012, with the
Army providing funds pursuant to the General Investigation Program, to study the
feasibility of implementing a,small project for flood risk management at Waiakea and
Palai Streams, Hilo, Hawaii; and
WHEREAS, to increase the efficiency of implementation, the Army has
recommended terminating the,study initiated under the feasibility cost sharing
agreement funded under the General Investigation Program, and is requesting that the
County execute anew feasibility cost sharing agreement and initiate a new study
funded under the Continuing Authorities Program, with all progress to date under the
existing study being carried forward to the new study; and
WHEREAS, all funds that the County has provided to date under the existing
study shall be carried forward to the new study so that no further funds will be required
from the County for the present fiscal year; and
WHEREAS, pursuant to Hawaii Revised Statutes Section 46-7, this Council's
consent is required to enter into this agreement; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with Hawaii Revised Statutes Section 46-7, that the Mayor of the County of
Hawaii is authorized to execute, 'on behalf of the County, the agreement and any related
documents with the United States Department of the Army, to agree to share costs in the
continuing study the feasibility of implementing a small project for flood risk management
at Waiakea and Palai Streams, Hilo, Hawaii:
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii shall
transmit copies of this resolution to the Office of the Mayor, the Finance Department,
the Department of Public Works, and the United States Department of the Army.
