Re: Agreement with the United State Department of the Army
Enclosed is a resolution to enter into an agreement with the United State Department of
the Army. This agreement partners the County with United State Department of the
Army Corps.of Engineers for the study of flood damage reduction pursuant to the
• authority provided by Section 205 of the Flood Control Act of 1948 (Public Law 80-858).

A. REQUEST:
Requesting for a resolution authorizing the Mayor to enter into a Memorandum of Agreement with the United
State Department of the Army, Pursuant to HRS § 46-7, for the County of Hawai'i to share costs for a
Waiakea-Palai Flood Risk Management Feasibility Study.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
This agreement partners the County of Hawaii with the United States Department of the Army Corps of
Engineers (ARMY), for the study of flood damage reduction pursuant to the authority provided by Section
205 of the Flood Control Act of 1948 (Public Law 80-858).
Previously (March 23, 2004 and March 23, 2012), the County of Hawaii and the ARMY had entered into
feasibility agreements providing funds pursuant to the General Investigation Program to study the feasiblity
of implementing a small project for flood risk management at Waiakea and Palai Streams in Hilo, HI.
If approved and executed, this new agreement will replace the old General Investigation Program feasibility
agreement, thus terminating the old feasibilty study initiated under the General Investigation Program. The
new agreement is requesting to initiate a new study funded under the Continuing Authorities Program, with
all progress to date under the existing General Investigation Program study being carried forward to the new
program/study. As such, all funds that the County has provided to date under the General Investigation
Program will also be carried forward so that no further funds will be required from the County for the present
fiscal year.
