RE: Bill No. 108; BOE Advisory Opinion
This follows Communication No. 739.1:
Council Member Kanuha and I are co-sponsors of Bill 108. Bill 108 seeks to address short-term
vacation rentals of residential units in zones not currently zoned or designated for hotel or resort
type uses. Concerns have been raised as to whether or not I have a conflict of interest because
my husband and I have owned a condominium unit at the Kona Islander Inn located in a resort
node in Kailua-Kona since 2005.
I requested the Hawaii County Board of Ethics (BOE) to determine whether or not I have any
type of conflict of interest and whether I may deliberate and vote upon Bill 108. On March 19,
2018, the BOE held a hearing on my petition that was open to the public. The BOE unanimously
found that I had no conflict of interest under the ethics code.
As I stated in my BOE petition, and at the hearing on my petition, I do not believe I have a
conflict of interest because Bill 108 seeks to create a program to address the commercial use of
residential dwellings as short-term vacation rentals in residential areas where the owner or
operator does not reside on the building site. My unit is located in a resort—zoned area and
designated for, and operated as, a transient accommodation under existing laws. I will neither
receive any land use privileges, nor any financial benefit through this legislation.
I have not yet received the BOE's written decision but will forward it to you as soon as I receive
it.
