ORDER OF RESOLUTIONS Res. 616-18: AUTHORIZES A DECREASE IN THE COUNTY OF HAWAII FUEL TAX FOR FISCAL YEARS 2018-2019 AND 2019-2020 Decreases the fuel tax by 5 cents per gallon for Fiscal Year 2018-2019, bringing it to 14 cents per gallon, and by 9 cents per gallon for Fiscal Year 2019-2020, bringing it to 14 cents per gallon. Fuel taxes may be used to support the safe and efficient operation of County roads, mass transit, and highway infrastructure. Res. 726-18: AWARDS A PUBLIC ACCESS, OPEN SPACE, AND NATURAL RESOURCES PRESERVATION MAINTENANCE STEWARDSHIP GRANT TO NA MAMO O KAWA Approves a grant of $62,658 to Na Mamo O Kdwa, a 501(c)(3) nonprofit organization, to protect, preserve, and restore the Kdwa properties (Tax Map Key: 9-5-016:006 & 025; and 9-5-017:005 & 007), pursuant to Section 10-16 of the Hawaii County Charter. A RESOLUTION AUTHORIZING A DECREASE IN THE COUNTY OF HAWAII FUEL TAX FOR FISCAL YEARS 2018-2019 AND 2019-2020. WHEREAS, the provisions of Section 243-5, Hawaii Revised Statutes, authorizes the Council of the County of Hawaii to determine by resolution the amount of the County fuel tax, which may be per gallon, one or more cents or a fraction of a cent or both, or zero; and WHEREAS, Section 243-5, Hawaii Revised Statutes, further provides that no such resolution shall be adopted until the County Council conducts a public hearing on the proposed tax, which shall be publicly noticed in the County at least twice and within a period of 30 days immediately preceding the date of such hearing; and WHEREAS, Section 243-6, Hawaii Revised Statutes, provides that in addition to expending fuel tax revenues for County highway construction and maintenance purposes, revenues may be expended for mass transit; and WHEREAS, on June 23, 2017, the County Council adopted Resolution No. 212-17, Draft 2, which authorized tax increases on liquid fuel and set the tax at 15 cents per gallon for fiscal year 2017-2018, 19 cents per gallon for fiscal year 2018-2019, and 23 cents per gallon for fiscal year 2019-2020; and WHEREAS, the County of Hawaii may consider other revenue sources for the improvement and maintenance of County roads, highway infrastructure, and mass transit, therefore, the County Council finds that additional increases to the fuel tax for future fiscal years are no longer necessary and that the fuel tax should be decreased to 14 cents per gallon for fiscal years 2018-2019 and 2019-2020; and WHEREAS, the County Council finds that the fuel tax should be decreased by five cents per gallon for fiscal year 2018-2019, thereby making the aggregate County of Hawaii fuel tax on liquid fuel at 14 cents per gallon for fiscal year 2018-2019; and WHEREAS, the County Council finds that the fuel tax should be decreased by nine cents per gallon for fiscal year 2019-2020, thereby making the aggregate County of Hawaii fuel tax on liquid fuel at 14 cents per gallon for fiscal year 2019-2020; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it does hereby fix, determine, and set the amount of the County of Hawaii fuel tax on liquid fuel to be levied and collected by the Department of Taxation of the State of Hawaii, in accordance with law, at 14 cents per gallon for fiscal years 2018-2019 and 2019-2020 for diesel on -highway and gasoline on -highway to be in effect going forward in subsequent years, unless and until otherwise provided by another resolution adopted as provided above. BE IT FURTHER RESOLVED that in accordance with Section 243-5, Hawaii Revised Statutes, this resolution shall take effect on the first day of the second month following the date of adoption of this resolution. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable Mayor Harry Kim; Director of Finance; Director of Public Works; Director of Taxation, State Department of Taxation; and Director of Finance, State Department of Budget and Finance.
